Do birds have fundamental right to fly and cannot be caged? Supreme Court to decide

NEW DELHI: The Supreme Court on Friday agreed to decide whether birds have fundamental rights to fly and caging them is violation of their rights.

A bench headed by Chief Justice HL Dattu agreed to examine the validity of Gujarat high court order holding that birds have fundamental right to fly.

The bench issued notice to Gujarat government on the appeal filed against HC order.

The HC had said: "It is the fundamental right of birds to live freely in the open sky, and it is the duty of every citizen to see that there is no unnecessary pain or suffering to animal or bird."
